Chip Roy and Tom Tiffany write letter to Trump administration warning about birth tourism

The Supreme Court heard oral arguments about President Trump’s executive order ending birthright citizenship for illegal aliens.

Members of the House Freedom Caucus warned that the Supreme Court upholding the 14th Amendment bestowing birthright citizenship on the children of illegal aliens represented a national security threat to the United States.

Roy explained how an individual from a foreign adversary like China could travel to America and give birth to a child who instantly became an American citizen with voting rights.

“American citizenship is a sacred trust — not a loophole to be exploited,” Roy state. “When foreign adversaries like the Chinese Communist Party can leverage birth tourism and visa-less programs to gain influence within our borders, we must restore integrity to our immigration system and defend the sovereignty of our Republic.”

33 members of Congress signed Roy and Tiffany’s letter to the Trump administration.

In the letter, the representative highlighted the growing number of Chinese nationals who traveled to the United States to engage in birth tourism.

“As you work tirelessly to secure our borders and immigration system to uphold the sovereignty and security interests of our nation, we write regarding an alarming report that the People’s Republic of China (PRC) is exploiting birthright citizenship and immigration parole programs created by the Obama and Biden administrations,” the letter stated.

The number of Chinese nationals who obtained U.S. citizenship through the 14th Amendment’s birth tourism loop hole numbered over one million.

“A January 17, 2025, news article estimates there are at least 750,000 and as many as 1.5 million Chinese nationals with U.S. citizenship who likely obtained it through a combination of the U.S.’s absurd birthright citizenship policies and the resulting birth tourism industry. As you know, pursuant to birthright citizenship, the children of foreign nationals including illegal aliens, are automatic U.S. citizenship if they were born on American soil. And through birth tourism, expecting mothers from abroad intentionally traveling to the U.S. and give birth, so they can reap the benefits of their child being a U.S. citizen,” the letter went on to say.

Roy and the other members of Congress argued that the Chinese nationals are now citizens who can vote in elections even though they owe their loyalty to China and will vote for politicians who stake out policy positions that benefit China.

“Further, the news report points out that this cohort of U.S.-born Chinese nationals is approaching adulthood, potentially allowing them to vote in U.S. elections despite being largely raised in China and lacking firm ties or allegiance to the United States, despite their American citizenship. The possibility of hundreds of thousands of individuals from a hostile nation voting in American elections, thereby influencing critical policy decisions of our constitutional republic, erodes the meaning of U.S. citizenship and our right to self-determination as a nation,” the letter added.

The issue of birthright citizenship is now before the Supreme Court.

But House Freedom Caucus members believe this issue isn’t just a matter of Constitutional interpretation.

They argue it’s also of fundamental to the safety and security of the United States.
