Tennessee Representative Andy Ogles has filed articles of impeachment against Judge Allison Burroughs, a federal judge on the U.S. District Court for the District of Massachusetts, accusing her of defying the Supreme Court after she temporarily blocked the administration from ending Temporary Protected Status for Somalis.
Burroughs issued the stay on Friday amid an ongoing lawsuit brought by African Communities Together, which argues the administration’s decision to end the designation was based on discriminatory grounds. The stay came months after the Supreme Court significantly curtailed lower courts’ ability to block TPS terminations, though the latest challenge is built on an amended complaint intended to work around that ruling.
Ogles’ resolution, first obtained by Fox News Digital, accuses Burroughs of having “defied the authority of both Federal law and the Supreme Court.” He went further in the resolution itself, writing, “In issuing this stay, Judge Burroughs attempted to get around the Supreme Court’s ruling in Mullin v. Doe by entertaining spurious allegations of racial and national-origin discrimination against an Administration that has chosen to not renew a single temporary protected status designation.”
DHS General Counsel James Percival offered a blunter assessment on social media Friday. “There is no serious debate about what is going on in these cases—defiance, obstruction, and delay,” he wrote.
Ogles was more direct still in a post on X announcing the filing. “I have just introduced articles of impeachment against radical judicial activist Judge Allison Burroughs for ignoring the Supreme Court and attempting to force mass migration from Somalia into American communities,” he wrote. “America is not Africa’s dumping ground. We will end Temporary Protected Status, remove those who have no lawful right to remain, and put the sovereignty of the American people FIRST.”
In a separate statement to Fox News Digital, Ogles said, “This judicial activist’s obstruction of the people’s will must be stopped. Judge Burroughs must be impeached.”
TPS is a humanitarian program that allows people to remain in the U.S. temporarily if their home countries are affected by war or natural disaster. Burroughs was appointed to the bench in 2014 by then-President Barack Obama.
The resolution is the latest in a string of impeachment efforts filed by the president’s allies against federal judges during his second term. A similar push against Judge James Boasberg stalled last year after senior lawmakers concluded impeachment was not the most effective way to address what they called “rogue” judges. Fox News Digital reported earlier this year that members of Congress intended to revive the broader campaign against judges they view as activist.
The Massachusetts district court has not responded to a request for comment on the impeachment threat.
The resolution now heads to the House Judiciary Committee, where its prospects remain uncertain given the fate of similar efforts earlier this year.
